Return, Exchange, and Refund Policy for O2M8-2-AI


This policy outlines the procedures and conditions for returns, exchanges, and refunds for the services provided by O2M8-2-AI, in accordance with the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA) of South Africa.

1. General Principles

  • Digital Services: As O2M8-2-AI provides digital services (Apps) and software-as-a-service (SaaS), our policy is adapted to the nature of these offerings. Unlike physical goods, digital services cannot be "returned" in the traditional sense.

  • Consumer Rights: We are committed to upholding your rights as a consumer. This policy is intended to be read in conjunction with our main Legal Notice and Terms of Service.

  • Fairness and Transparency: Our goal is to be transparent and fair in all our dealings. We encourage you to read this policy carefully before subscribing to our services.

2. Cooling-Off Period for Electronic Transactions

In line with the Electronic Communications and Transactions Act (ECTA), you are entitled to a "cooling-off" period.

  • You may cancel your subscription without reason and without penalty within seven (7) days of the initial conclusion of the agreement (i.e., your initial subscription date).

  • To exercise this right, you must notify us in writing within the seven-day period to info@automate2ai.tech.

  • Upon cancellation within the cooling-off period, you will receive a full refund of any subscription fees paid.

  • Exception: This cooling-off right lapses if you have commenced using the services with your consent before the seven-day period expires.

    3. Refunds for Service Deficiencies

Under the Consumer Protection Act (CPA), you are entitled to a refund, replacement, or repair if the services or goods you receive are defective or do not meet the agreed-upon standards.

  • Unsuitable for Purpose: If you have informed us of a particular purpose for which you require our services, and we have advised that our services will meet that purpose, you may be entitled to a refund if the services are not suitable. You must notify us within ten (10) business days of discovering the unsuitability.

  • Defective Services: If our services are found to be defective or fail to perform as described, you may be entitled to a remedy. This includes situations where the service does not comply with applicable standards or is of poor quality. You have up to six (6) months from the date of the transaction to report such defects.

  • Our Process: Upon receiving a claim for a refund due to service deficiency, we will investigate the issue. This may require your cooperation in providing information and access to diagnose the problem. If the claim is validated, we will, at your choice, offer a pro-rata refund for the period the service was deficient, or a credit for future services.

4. How to Request a Refund or Cancel a Subscription

  • All requests for refunds or cancellations must be submitted in writing to our designated support email address: info@automate2ai.tech.

  • Your request should include your full name, contact details, subscription details, and a clear reason for the request, with supporting evidence where applicable.

  • We will acknowledge receipt of your request within [e.g., 2 business days] and aim to process it within [e.g., 10-15 business days].

5. Subscription Renewals and Cancellations

  • Cancellation: You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. You will continue to have access to the service until the end of that period.

  • No Pro-Rata Refunds for Mid-Cycle Cancellations: Outside of the initial 7-day cooling-off period, we do not offer pro-rata refunds for cancellations that occur mid-billing cycle.

  • Fixed-Term Agreements: If you are on a fixed-term agreement (e.g., an annual contract), you may cancel by providing 20 business days' notice. A reasonable cancellation penalty may apply, as per the CPA.

6. Exchanges

Due to the nature of our digital services, we do not offer "exchanges" in the traditional sense. If you have subscribed to an incorrect service tier, please contact our support team to discuss upgrading or downgrading your subscription plan.

7. Important Considerations

  • No General Right of Return: It's important to note that under South African law, there is no general right to a refund if you simply change your mind after the cooling-off period has expired.

  • Clear Rules: This policy outlines clear rules for refunds to ensure consistency and fairness. We do not typically determine refunds on a case-by-case basis outside of these established terms.

  • Policy Updates: O2M8-2-AI reserves the right to amend this policy at any time. The updated policy will be effective upon posting on our website.
